Chapter 7 Bankruptcy

Under this chapter, you are allowed to discharge your debt.  This is for the debtor who cannot pay off his or her debts even if given time.  In order to qualify for Chapter 7, you must satisfy a "means test."  If your income is under the median average income of a family your size in your area, you automatically pass the means test.  If your income is over the median income, you still may qualify through the means test formula taking into account your income and expenses.

Chapter 13 Bankruptcy

If you do not qualify for Chapter 7, you may still qualify for Chapter 13.  Under this chapter, you pay off your debts over a three to five year period. You get to keep your property and enjoy protection from creditor actions. To qualify for Chapter 13, you must demonstrate that you have the income to make the plan payments.  If you do not, you may still qualify by shedding some of your more expensive secured obligations by returning the security.
