DEBT ELIMINATION VS. DEBT CONSOLIDATION: FREQUENTLY ASKED QUESTIONS

A weak job market, rising oil prices and the lingering affects of the war in Iraq have given credit rating and asset-backed securities analysts reason to believe that debt-heavy consumers will face tougher times in 2003. With today’s consumer debt burden continuing to climb, experts say the outlook for consumer credit is bleak as late loan payments and defaults rise, and U.S. consumers, with less disposable income, take on more debt by taking advantage of rock-bottom interest rates.



BANKRUPTCY: THE LAST RESORT

Nearly 1.5 million Americans declared bankruptcy in 2002, and if the trend continues as it has in the past, the number of bankruptcies will increase in 2003. According to the Administrative Office of the U.S. Courts, the non-business filings (consumer cases), which make up the majority of bankruptcy filings, set a record breaking increase of 7.8 percent in fiscal year 2002 (Oct. 1 through Sept. 30) from the previous year. Business filings in the 12-month period ending Sept. 30, 2002 were up 1.6 percent from the same period in 2001. Filings in the three-months ending Sept. 30, were up 12 percent from the same period in 2001 — the highest three-month total in U.S. history.



BANKRUPTCY: FREQUENTLY ASKED QUESTIONS

Unlike debtors in 18th century England who were imprisoned or faced the death penalty for not paying their bills, modern day debtors in the United States need not fear either fate for not paying their debts. While early British bankruptcy laws did little to protect debtors, who were considered quasi-criminals, the sweeping changes made by Parliament in 1705 were similar to the first American bankruptcy law adopted by Congress in 1800. Today, the U.S. bankruptcy law, which has experienced only a few major changes during its 200-plus year history, has made it easier for debt-ridden consumers to eliminate all of their unsecured debt without the fear of losing any of their possessions in the process.

According to figures released by the Administrative Office of the U.S. Courts earlier this year, more Americans filed for bankruptcy during the first quarter of 2003 than in any other previous quarter in history. Continuing to break historic records, the number of new cases filed during the first three months of 2003, reported at 412,968, represents a 9.0 percent increase from the same period in 2002.
