When a client contacts us regarding debt litigation, we conduct a thorough
investigation to learn available defenses. These defenses may include
fraud, failure of consideration, defective products, failures to comply
with the Truth in Lending Act and more. We put in an answer and if appropriate
present a counterclaim for damages. We then energetically represent the
client in the courtroom proceedings.
Debt negotiation is sometimes an option. If our client can put together a lump sum, we
may offer to settle the matter with a payoff of 40% to 60% of the outstanding balance.
If our clients are
home owners facing foreclosure, we examine the loan documents for defenses including
fraud and predatory lending practices. We then contact the lender and
press for an adjustment.
If our client owes more than the value of the home and is having trouble
with the payments, we seek a loan modification with payments our client
can afford. If loan modification is not available, we may recommend our
client seek a
short sale. Under this procedure, the client finds the best buyer he can, even if
for a lesser amount than the loan balance. We then negotiate with the
lender to accept the buyer's offer in full satisfaction of the loan.
